HOW TO FILE A FOIA

Fairport tax payers have a vital weapon in their arsenal: the Freedom of Information Act (FOIA) or as FCSD calls it, Public Inspection of Records (FOIL)


Exercise your right under New York's Freedom of Information Act and public records laws to get documents related to your issue of concern. The Freedom of Information Law (Public Officers Law, Article 6) (FOIL) grants members of the public access to the records of government in accordance with its provisions. For more information about FOIL and the Personal Privacy Protection Law (Public Officers Law, Article 6-A), please visit https://opengovernment.ny.gov/


Individuals can file a lawsuit against FCSD for failing to respond to, or provide rationale for, not responding to a request.  FCSD has to respond to a request within 30 days.  If they deny a request, individuals can appeal within 20 business days and FSCD must respond with a written explanation of why the request was denied within 10 days.


Public school records available include emails from the email addresses of public school officials (including principals, school board members, teachers, staff and anyone with a school email address). Also available are contracts, curriculum, trainings, videos, text messages and other records that provide valuable information about events, classes and other issues that may cause you concern. 


We have experience filing public records requests, so contact us with tips and ideas that you’ve got for documents we should try to get; if we agree, we’ll get a request out the door. It usually takes anywhere from a few days to several weeks to get results, but the results are usually very rewarding!

FCSD FOIL REQUEST INFORMATION

For an easy way to  get started is with the Public Records Letter Generator. This service was designed to assist journalists and other citizens obtain access to public records maintained by state or local government officials, however it is a great tool for parents to obtain information from FCSD.

Records will be made available for public inspection during normal business hours, 8:00 a.m. to 4:30 p.m. The fee for copying records shall be $.25 per page for documents not exceeding 8.5 x 14. Electronic versions can be emailed free of charge unless otherwise stated that copies must be made for redaction purposes.


When a request for information or records is denied, the person making the request has the right to appeal within 30 days from the date of denial to:
